Заключение: чего я стремился добиться этой книгой?

Читатель, следовавший за моими рассуждениями в этой книге, давно понял, что я не пытаюсь систематически или методически представить свои взгляды. Возможно, такая попытка будет предпринята позже. Вместо этого книгу следует воспринимать как ряд занятий, попытку достичь единства теории и практики. Так, часть глав, особенно 2-я, 3-я, 4-я, 10-я и 11-я, исследует практические области, с которыми я знаком, как практикующий юрист и политический активист. Другие главы – продукт моего глубокого убеждения, что участие в «воплощённой социальной практике» подвигает мыслящее человеческое существо стремиться к достижению наибольшей возможной степени адекватного теоретического понимания оснований и цели предпринятой работы. И, конечно, теоретический труд – всё же труд. Именно поэтому несколько глав содержат энергичную критику ряда современных специалистов – Хабермаса, Бадью, Жижека, Дузинаса, Перрина, помимо прочих,– которые искали во всевозможных стилистических диапазонах и философских традициях понимания чрезвычайного расцвета дискурса и практики прав человека после Второй мировой войны. Для меня, только через такие стычки может прокладывать себе путь оригинальная мысль.

Должно также быть очевидно, что философская ориентация этой книги – Аристотель, Спиноза, Гегель, Маркс (который не только глубоко почерпнул критического в Гегеле, но и на заре своей интеллектуальной карьеры позаимствовал существенную часть трудов Спинозы), Ленин и Бадью. Хотя ни Маркс, ни Ленин не признали бы «марксистской» значительную долю моей книги, я с уверенностью занимаю место в их традиции. В этом пункте я совершенно не согласен с Энтони Карти, который в своей новой книге говорит следующее:

«Постмодернизм – это истощенный моральный дух старых европейцев, а призраки марксистских интерпретаций империализма предлагают нам наиболее убедительные объяснения того, почему насилие Соединённых Штатов растёт год от года»[931]931

Я старался не представить пессимистический взгляд, а разделить «штурмующую небеса» приверженность Маркса и Ленина к великолепию человеческого духа в сопротивлении и иногда преодолении эксплуатации. В конце концов, поэтому утверждением этой книги было, что принципы современного международного права и прав человека, возникнув из революционной борьбы до и особенно после Второй мировой войны,– не просто риторика или утопические и невозможные пророчества, но реальное, материальное оружие нападение и обороны в человеческой борьбе за эмансипацию.

Это и есть значение, которое я вкладываю в выражение «революционный консерватизм». Я подразумеваю жизненную важность для всякой серьёзной теоретической и практической политики «защиты чести» великих революций – Французской и Российской – и замечательной послевоенной истории антиколониальной борьбы. Не случайно, что каждое из этих исторических событий связано с выдающимися и длительными продвижениями в действительности прав человека. Это – чувство, в котором права человека – не простая риторика, формулировка, лицемерно задействованная сильными, подрыв борьбы угнетённых. Международное право включает в свои принципы и понятия содержание колеблющих мир движений, содержание, способное, иногда непредсказуемо, возродиться, неся страшное возмездие за несправедливость.
